By accessing or using the Trellis MTSS platform (the "Service") — whether through trellismtss.com or any associated application — you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy. If you are accepting these Terms on behalf of a school, district, or other organization, you represent that you have authority to bind that organization, and "you" refers to both you individually and that organization.
If you do not agree to these Terms, do not access or use the Service.
Trellis is an MTSS (Multi-Tiered System of Supports) platform developed and operated by Oncore, LLC. The Service enables educators to document Tier 1 classroom interventions, track student progress over time, generate actionable data visible to teachers and administrators, and support schoolwide and districtwide MTSS implementation.
Features available to you depend on the subscription plan held by you or your institution. We reserve the right to modify, suspend, or discontinue features of the Service at any time, with reasonable notice where practicable.
To access most features of the Service, you must create an account. You agree to provide accurate, current, and complete information during registration and to keep your account information updated.
You are responsible for safeguarding your password and for all activity that occurs under your account. You must notify us immediately at info@trellismtss.com if you suspect unauthorized access to your account. We are not liable for losses arising from compromised credentials that result from your failure to maintain appropriate security practices.
When the Service is deployed at the school or district level, a designated administrator account controls access for other users at that institution. The institution is responsible for managing user access, including promptly deactivating accounts for personnel who no longer require access.
The Service is designed for use by educators and school administrators who are 18 years of age or older. Accounts may not be created by or for individuals under 18 except as expressly authorized by the school or district administrator for legitimate educational purposes under applicable law.
You agree to use the Service only for lawful purposes and in accordance with these Terms. You must not:
We reserve the right to investigate potential violations and to suspend or terminate access without notice where we believe a violation has occurred or is imminent.
You and your institution retain ownership of all data you input into the Service, including educator notes, intervention records, and student progress data ("Customer Data"). We do not claim ownership of Customer Data.
By submitting Customer Data to the Service, you grant Oncore, LLC a limited, non-exclusive, worldwide license to process, store, and display that data solely as necessary to provide and improve the Service as described in these Terms and our Privacy Policy.
When the Service is used in connection with student education records covered by FERPA, the school or district is the data controller and we act as a "school official" or authorized service provider under FERPA. We will not disclose student education records except as permitted by FERPA, our Customer agreement, and applicable law. We do not use student data for advertising or to build profiles for non-educational purposes.
You may request an export of your Customer Data at any time by contacting us at info@trellismtss.com. Upon termination of your subscription, we will make Customer Data available for export for a period of 30 days, after which it may be deleted from our systems.
The Service, including its software, design, text, graphics, logos, and all other content created by Oncore, LLC, is owned by or licensed to Oncore, LLC and is protected by copyright, trademark, and other intellectual property laws. These Terms do not transfer any such rights to you.
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your internal educational or administrative purposes. This license does not include the right to copy, modify, distribute, sell, or create derivative works of any part of the Service.
If you provide us with feedback, suggestions, or ideas about the Service ("Feedback"), you grant us a perpetual, irrevocable, worldwide, royalty-free license to use that Feedback for any purpose, including improving the Service, without any obligation to compensate you.
Certain features of the Service require a paid subscription. Subscription fees, billing cycles, and included features are described on our pricing page and in any order form or agreement between you or your institution and Oncore, LLC.
These Terms remain in effect for as long as you have an active account or use the Service.
You may terminate your account at any time by contacting us at info@trellismtss.com or through the account settings in the Application. Termination does not entitle you to a refund of any prepaid fees.
We may suspend or terminate your access to the Service immediately, without prior notice, if we determine that you have violated these Terms or if we are required to do so by law. We may also terminate the Service generally upon reasonable notice to users.
Upon termination, your right to access and use the Service immediately ceases. Sections of these Terms that by their nature should survive termination (including intellectual property, disclaimers, limitations of liability, and governing law) will survive.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, ONCORE, LLC DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components. We do not warrant that the results obtained from use of the Service will be accurate or reliable. Any reliance you place on the Service for educational, clinical, legal, or compliance decisions is at your own risk.
Trellis is an educational documentation tool. It is not a substitute for professional judgment by educators, administrators, or specialists. Intervention documentation produced by the Service does not constitute clinical, psychological, or legal advice.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL ONCORE, LLC, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES — INCLUDING LOSS OF DATA, LOSS OF PROFITS, LOSS OF GOODWILL, OR BUSINESS INTERRUPTION — ARISING OUT OF OR IN CONNECTION WITH THESE TERMS OR YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ANY CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE FEES PAID BY YOU OR YOUR INSTITUTION TO ONCORE, LLC IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100).
Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities. In such jurisdictions, our liability is limited to the greatest extent permitted by applicable law.
You agree to defend, indemnify, and hold harmless Oncore, LLC and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in connection with:
These Terms are governed by and construed in accordance with the laws of the State of Utah, United States, without regard to its conflict of law provisions.
Any dispute arising from these Terms or your use of the Service shall first be addressed through good-faith negotiation. If negotiation fails, disputes shall be resolved by binding arbitration in Salt Lake County, Utah, under the rules of the American Arbitration Association (AAA), except that either party may seek injunctive or other equitable relief in a court of competent jurisdiction to prevent actual or threatened infringement, misappropriation, or violation of intellectual property rights.
You agree that any dispute resolution proceeding will be conducted only on an individual basis and not in a class action or representative proceeding. If this waiver is found unenforceable, the class action or representative claim must be litigated in court rather than arbitration.
We reserve the right to modify these Terms at any time. When we make material changes, we will update the "Last updated" date above and provide notice via email (to the address on your account) or a prominent in-app notification at least 30 days before the changes take effect.
Your continued use of the Service after the effective date of any changes constitutes your acceptance of the updated Terms. If you do not agree to the revised Terms, you must stop using the Service and may terminate your account as described in Section 8.
